The Statute of Limitations for Credit Card Debt Collection in Oklahoma
If a written credit card agreement signed by the debtor can be produced, the statute of limitations for a credit card debt is five years from (1) the date of the last voluntary payment by the debtor or (2) proof of a purchase or cash advance. If it is a first payment default, the five year statute of limitations from the due date of the first payment.
If a written credit card agreement signed by the debtor cannot be produced, the statute of limitations for a credit card debt is three years from the date of the last voluntary payment by the debtor or proof of a purchase or cash advance, or if it is a first payment default, three years from the due date of the first payment.
