- If the debtor signed a document in which the debtor agreed to be liable for the cost of the medical services, the statute of limitations for a medical debt is five years from the date of service or five years from the date of the last voluntary payment by the debtor.
- If the debtor did not sign a document in which the debtor agreed to be liable for the cost of the medical services, the statute of limitations for a medical debt is three years from the date of service or three years from the date of the last voluntary payment by the debtor.
- If a patient signed a document agreeing to be liable for the cost of the medical services and the patient’s spouse did not, as stated above the statute of limitations is five years for the patient and three years for the spouse.
